1. About My Gravel Buddy

My Gravel Buddy LLC (“My Gravel Buddy,” “we,” “us,” or “our”) operates mygravelbuddy.com (the “Site”) as a nationwide broker for bulk gravel and aggregate materials (“Materials”). We match customers with a network of independent local material partners and delivery haulers across the country. “Services” refers to the Site itself, our order and dispatch process, and our customer support.

2. Agreeing to These Terms

Using the Site, placing an order, or contacting us by phone or text means you accept these Terms and our Privacy Policy. If something here doesn’t work for you, please don’t use the Services. To order, you need to be 18 or older and able to legally enter into a contract.

3. How the Brokerage Works

My Gravel Buddy doesn’t quarry, manufacture, or warehouse any Materials, and we don’t own or operate trucks. Think of us as the coordination layer: we take your order, match it to a local partner who has the material, and a hauler who can deliver it, then we handle payment and support on the back end.

That means:

Partners and haulers run their own independent businesses. They aren’t My Gravel Buddy staff, franchisees, or agents, and we don’t supervise how they run their day-to-day operations. Except where these Terms say otherwise, we’re not on the hook for what a partner or hauler does or fails to do.

4. Pricing and Placing an Order

Prices you see on the Site are estimates built from the material type, quantity, and your delivery zip code, actual cost can shift based on partner availability, current market rates, and the real driving distance to your site. If the confirmed price ends up more than 10% above the estimate you were quoted, we’ll reach out before locking anything in, and you’re free to walk away with no cancellation charge if you’d rather not proceed at the new price.

An order isn’t guaranteed just because you submitted it, it becomes confirmed only once we’ve lined up both a partner and a hauler and sent you an email confirmation. Availability differs by market, and Materials are typically sold in tons or cubic yards as approximate quantities (see Section 9 for how we handle load variance).

5. Locking In Your Order

Shortly before your scheduled delivery, we’ll send you a confirmation covering the material type, size, quantity, and delivery window.

Once you approve that confirmation, the order is locked, no further cancellations or refunds apply, except where the law requires otherwise or Section 10 says differently. If anything about the material changes before we schedule delivery (for example, if we need to swap partners), we’ll flag it to you first, and you can either proceed or take a full refund.

Delivery timing is our best estimate, not a promise: weather, traffic, mechanical issues, and partner or hauler scheduling can all push things around.

7. Making Sure Your Site Can Take the Delivery

When you order, you’re confirming a few things about your property:

If the truck genuinely can’t get in safely, the hauler will get as close as they reasonably can. Failed deliveries due to access problems may carry a missed-delivery fee, and rescheduling a second attempt may carry a re-delivery fee.

8. If Something Gets Damaged

Let’s be upfront: dump trucks are heavy, and delivering large volumes of loose material always carries some risk to driveways, curbs, lawns, irrigation lines, fences, or buried utilities. Here’s how we handle it if it happens:

Think something got damaged? Reach out within 72 hours with photos and a quick explanation of what happened. We’ll work with you and the hauler in good faith to sort it out. Formal claims need to come in within 14 days of delivery, after that, we can no longer meaningfully verify site conditions, so late claims won’t be accepted.

Tip: snap a few photos of your driveway and drop area before the truck shows up, and double-check your homeowner’s/property insurance is current.

9. When the Load Isn’t Exactly What You Ordered

Bulk material is loaded by weight, and getting an exact match to what you ordered isn’t realistic: moisture content, temperature, and other climate factors can all affect how much a given load weighs, so expect delivered quantity to land within 20% of your order, plus or minus.

We charge at the time you place your order, and giving us your payment details authorizes that charge for the amount shown at checkout. If your order never gets confirmed, or the price moves more than 10% and you decide not to proceed, you’ll be refunded in full. Declined charges or chargebacks will cancel the order in question, and repeated issues may mean we pause your ability to place future orders until things are resolved.

Everything on the Site (copy, graphics, logos, the My Gravel Buddy name and branding) belongs to us or to whoever licenses it to us, and it’s protected under applicable IP law. Don’t copy, redistribute, or build derivative works from it without asking us first.

15. No Warranties

We provide the Site and everything on it (including all Materials-related information) on an “as is” and “as available” basis. That means no promises, spoken or implied, including no implied promise of merchantability, fitness for a particular purpose, or non-infringement. We can’t guarantee the Services will run without interruption or error, and we can’t guarantee that pricing, descriptions, or availability info on the Site is always current or accurate. Because partners and haulers are independent businesses we don’t control, we also can’t promise anything about how well, how fast, or how consistently they’ll perform.

16. How Much We Can Be Liable For

Here’s the ceiling on our liability, to the extent the law allows it:

Heads up: a handful of states don’t allow limits on implied warranties or certain damage exclusions, so parts of this section might not fully apply where you live.

17. If a Claim Comes Our Way Because of You

If someone brings a claim against us, and it traces back to how you used the Services, a Terms violation on your part, false info you gave us about an order, damage or injury caused by something you didn’t disclose about your site, or you breaking a law or someone else’s rights, you agree to cover our resulting costs, including reasonable legal fees, and to help us defend against it.

18. Resolving Disputes

Talk to us first. Most issues get sorted out fast if you just reach out to office@mygravelbuddy.com.

If that doesn’t work, it goes to arbitration. Any dispute we can’t resolve directly gets handled through individual, binding arbitration through the American Arbitration Association under its Consumer Arbitration Rules (see adr.org for details). Arbitration happens in Oregon, or remotely by phone or video if that’s easier. We’ll typically cover the AAA filing and admin fees on consumer claims; each side pays their own attorney unless the arbitrator decides a claim was frivolous or brought in bad faith.

No class actions. Claims go one-on-one, not as part of a class, group, or representative case, and the arbitrator can’t combine multiple people’s claims into one proceeding. If a court somewhere decides this class-action waiver doesn’t hold up for a particular case, that one case moves to the courts named in Section 19 instead of arbitration.

Small claims is still an option. Either of us can bring an eligible claim there instead of arbitration.

You can opt out. Within 30 days of your first order or first agreeing to these Terms, email office@mygravelbuddy.com with “Arbitration Opt-Out” in the subject line, along with your name and order email, and arbitration won’t apply to you, disputes go to the courts in Section 19 instead.

19. Governing Law

These Terms follow Oregon law, regardless of conflict-of-law rules. Outside of arbitration (Section 18), any court case gets filed in state or federal court in Multnomah County, Oregon.

20. When Things Are Out of Our Hands

Stuff happens that neither of us can control: natural disasters, extreme weather, public health emergencies, government orders, labor strikes, transportation breakdowns, equipment failure. If one of those events keeps us from delivering, we’re not liable for the delay. We’ll let you know as soon as we reasonably can and do what we can to get things moving again. If the disruption drags past 14 days, either of us can cancel the order and you’ll get a full refund.

21. Updates to These Terms

We’ll update this page as needed and adjust the “Last Updated” date when we do. If you keep using the Services after an update goes live, that means you’re on board with the new version, it’s worth checking back occasionally.
